How It Works

How to Get a Marriage Contract

Simpler than you think — here’s exactly what happens.

What to Prepare Before You Apply

  • Both partners’ full names — as they appear on your ID documents
  • Both partners’ ID numbers
  • Your planned wedding date
  • Your decision: accrual or no accrual? — not sure? Read our guide
  • Commencement values (if choosing accrual) — we’ll help you calculate this
  • Any special clauses — e.g., exclusion of specific assets from accrual sharing

The Process — Step by Step

Step 1: Apply Online (10 minutes)

Complete our secure online form. We typically respond within one business day.

Step 2: We Draft Your Contract

Our attorneys draft your marriage contract. We send you the draft to review before anything is signed.

Step 3: Sign Before a Notary

In Pretoria? Visit our office — our notary is on site.
Anywhere else in SA? We arrange a notary in your area or handle it by correspondence.

Step 4: Deeds Office Registration

We lodge your signed contract at the Deeds Office. Must be registered within three months of signing and before the wedding.

Step 5: Confirmation

Once registered, you receive confirmation. Your marriage contract is legally binding.
